Rule 4 of 7

The affidavit

  1. The words

An affidavit is a written statement sworn before an officer authorized to administer oaths. The jurat is the clause proving the swearing happened.

The actual law, so it can’t scare you later.

  2. Actually means

Acknowledgment says "that is my signature." Affidavit says "these statements are TRUE, and I swore to it in front of you."

Plain English. No legalese survives this step.

  3. Live example

A parent signs an affidavit of residence for a school, you administer the oath, then you complete the jurat.

    A scene you can picture.

  4. Killer question

The person who makes an affidavit is the affiant. Affidavit gets a jurat; a plain signed document gets an acknowledgment.

Exactly how the exam asks it.
