Rule 2 of 7

Acknowledgment

  1. The words

Taking an acknowledgment means certifying that a person appeared before you, was known or proven to be the signer, and acknowledged executing the document.

The actual law, so it can’t scare you later.

  2. Actually means

They do not have to sign in front of you. They appear, prove who they are, and confirm "that is my signature, I signed it willingly." You certify that.

Plain English. No legalese survives this step.

  3. Live example

A seller signed a deed at home on Tuesday. Today she appears with ID and says she executed it. You complete the acknowledgment certificate. Everyday, legal.

    A scene you can picture.

  4. Killer question

The trap is personal appearance. An acknowledgment taken over the phone, or without the person before you, is illegal and serious misconduct. If a question says "called the notary," the answer is misconduct.

Exactly how the exam asks it.
