Rule 7 of 7 · The acts

Proof of execution

  1. The words

A subscribing witness, someone who watched the signing, can appear before you, swear they saw it happen, and you certify the proof.

From the handbook: Real Property Law 304; License Law booklet, Definitions: Proof

  2. Actually means

The signer does not have to show up. A witness who saw them sign stands in.

Plain English. No legalese survives this step.

  3. Live example

A signer cannot come in, but the person who witnessed the signature appears, swears to it, and you certify the proof of execution.

    A scene you can picture.

  4. Killer question

Recognize the term "subscribing witness." Fee: $2, plus $2 for swearing the witness.

Exactly how the exam asks it.
