What happens if a New York notary makes a mistake?

It depends on the mistake. Executive Law § 142-a saves the document from certain honest defects, like an expired term, ineligibility, a misnamed notary, or an unfiled oath, so innocent paperwork stays valid. But § 142-a never shields the notary from criminal liability, and it doesn’t cover a defect the notary knew about.

The trap on the exam

Students think § 142-a either voids the document or fully protects the notary. Neither is right. The saving statute keeps the paperwork alive for innocent parties, but the notary still answers for wrongdoing. Remember the shape: the document survives, the notary stays exposed.

A real example

A notary’s commission quietly expired last month. Not knowing, she takes an affidavit for a deponent who also doesn’t know. Under § 142-a the affidavit stays valid, so the deponent isn’t punished for her lapse. She, though, keeps full exposure to prosecution for acting without a valid commission. The paper is saved; she is not.

What the law says

Executive Law § 142-a validates notarial acts despite defects such as ineligibility, misnomer, an unfiled oath, an expired term, or a vacated office, which protects innocent parties. It does not help a person who knew of the defect or where it was apparent on the certificate’s face (within six months), and it never relieves the notary of criminal liability.
