Can a New York notary give legal advice?

No. A non-attorney New York notary may not give legal advice or draft legal papers of any kind, including wills, deeds, mortgages, contracts, and leases. You verify signatures and administer oaths; you don’t tell people what a document means or which one to sign. Crossing that line is the unauthorized practice of law.

The trap on the exam

The booklet lists four numbered prohibitions, and the exam hides one lawful act among them. Notarizing a form the customer already filled out is your job. Advising them on how to fill it out, drafting it, splitting fees with a lawyer, and advertising powers you don’t have are the four things you cannot do.

A real example

A customer slides a blank power-of-attorney form across the counter and asks which box makes her son the agent. You can notarize the form once she completes and signs it. You cannot tell her which box to check or fill it in for her. That choice is legal advice, and it belongs to a lawyer.

Remember it as You notarize the paper. You don’t explain it, draft it, or sell it.

What the law says

The booklet lists four unauthorized-practice-of-law prohibitions for non-attorney notaries: no giving legal advice or drawing legal papers (wills, deeds, mortgages, contracts, leases, and the like); no soliciting legal business for a lawyer for consideration; no splitting fees with a lawyer; and no advertising powers the law does not give. Violations can bring removal from office plus fine or imprisonment (Judiciary Law §§ 484-485).
